The Rescue Rob’s Roadside Terms and Conditions (“User Terms”) constitute a legally binding agreement between Rescue Rob’s Roadside EMERGENCY ROADSIDE SERVICES (“Rescue Rob’s Roadside”, “we,” “us,” or “our”), the owner and operator of the https://mycarunlocker.com/ website and its related software application and platform (hereafter, collectively referred to as the “Rescue Rob’s Roadside”) and you (“you” or “you’re”), the user of Rescue Rob’s Roadside.

BY USING RESCUE ROB’S ROADSIDE IN ANY FORM OR FASHION (INCLUDING, WITHOUT LIMITATION, NAVIGATING HTTPS://MYCARUNLOCKER.COM/ OR UTILIZING THE RESCUE ROB’S ROADSIDE MOBILE APPLICATION OR ONLINE PLATFORM), YOU ACKNOWLEDGE AND AGREE TO THESE USER TERMS, AND RESCUE ROB’S ROADSIDE PRIVACY POLICY AND WHICH ARE INCORPORATED HEREIN BY REFERENCE. IF YOU DO NOT AGREE WITH ANY OF THESE TERMS, YOU MAY NOT USE RESCUE ROB’S ROADSIDE.

THE USER TERMS ARE INTENDED FOR ALL USERS OF RESCUE ROB’S ROADSIDE, INCLUDING THOSE WHO ARE SIMPLY NAVIGATING THE WEBSITE OR THOSE WHO REGISTER AN ACCOUNT. HOWEVER, DIFFERENT SECTIONS OF THE USER TERMS AFFECT USERS DIFFERENTLY, SO PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY.

TERMS AND CONDITIONS FOR CREDIT CARD PAYMENTS AND SERVICES 

1.    Rescue Rob’s Roadside Overview

Rescue Rob’s Roadside operates an online platform where users can connect directly with our Locksmith service providers (hereafter, “Providers”). Users can access our services via https://mycarunlocker.com/, our mobile application, or through specific third-party platforms accessible on a single mobile device (smartphone) or computer. We act as the direct employer and fully manage and oversee all transactions between users and Providers.

We take responsibility for the quality, safety, legality, and all other aspects of the services provided by our Providers. We ensure the accuracy of the information and pricing provided by Providers. As the direct employer, we are not merely facilitators but are actively involved in the service transactions.

We strive to provide the highest quality of service and uphold rigorous standards for all our Providers. To enhance user satisfaction and trust, we offer guarantees and warranties relating to the services rendered by our Providers. Our platform’s tools encourage direct communication between users and Providers, ensuring clarity and service excellence.

All transactions between users and Providers are managed with our oversight to ensure the highest service delivery and customer satisfaction.

We prioritize customer information and privacy as outlined in our Privacy Policy https://mycarunlocker.com/, which is fully incorporated herein by reference.

By scheduling services and using a credit card for transactions at Rescue Rob’s Roadside, you agree to these terms and conditions.

2.    Charges, Prices, and Payment Terms for Rescue Rob’s Roadside

Service Charges:

When you utilize Rescue Rob’s Roadside, you agree to pay for the services or goods received. All payments must be made directly to Rescue Rob’s Roadside.

*A $35 service fee applies to all service calls. This fee covers dispatch costs and is non-refundable. Additional charges for services may vary based on the type of assistance required.

Payment to Us:

Payments for all services rendered are to be made directly to us at the time of service.

Adjustment of Charges:

Charges may be subject to adjustment if there is a discrepancy between the services requested and those provided. You agree to pay any adjusted charges as billed.

Price Adjustments:

We reserve the right to modify service charges at any time. While we will make reasonable efforts to notify you of applicable changes, you must remain informed of current rates. All charges incurred under your account are your responsibility.

Refunds and Disputes:

Charges are typically final and non-refundable.

If you encounter an issue with a charge—such as requests for cancellations, refunds, or corrections—you must notify us within 30 days of the charge date. Failure to do so waives your right to dispute the charges.

Service Rates:

Service rates are subject to change without prior notice. It is your responsibility to stay updated on the latest rates for services.

Payment Obligation:

You agree to pay all charges for services procured from us, including applicable taxes and service fees. Payment is due upon scheduling the service, and all payments are non-refundable except as required by law.

Third-Party Payment Processor:

We use a third-party payment processor (e.g., Authorize.Net) to handle credit card transactions. Your payments are subject to the terms and policies of the payment processor and credit card issuer.

Liability for Payment Processing:

Rescue Rob’s Roadside is not responsible for errors, delays, or other issues caused by the payment processor. By using our services, you release us from liability for the payment processor’s actions or omissions.

Transaction Details:

We will collect and store transaction details regarding your use of our services, which our Privacy Policy will handle.

Credit Card Authorization:

By using our services, you authorize Rescue Rob’s Roadside to charge your credit card for the total amount of the service at the time of the transaction. All payments are subject to approval by the financial institution issuing your card.

Acknowledgment of Services Rendered:

By signing and authorizing payment, you:

  1. Confirm that the requested services have been provided directly or indirectly to someone on your behalf.
  2. Agree to the terms and conditions, including our Privacy Policy.

Payments on Behalf of Others:

If you are paying for services on behalf of another person:

  • You acknowledge that your payment does not entitle you to a chargeback claim simply because you did not personally receive the service.
  • Authorizing the payment confirms your agreement to pay for the service rendered to the recipient, regardless of your physical service receipt.

By proceeding with payment, you agree to these terms and authorize Rescue Rob’s Roadside to complete the requested service and process the corresponding charges.

3.     Product Sales & Service Policy

Final Sale Terms:

All sales of car batteries, car keys, remotes, and other products are considered final and are sold “AS IS” unless the customer purchases a warranty at the time of sale.

Warranty and Remedies:

If a customer encounters an issue with any product, Rescue Rob’s Roadside will evaluate the situation and, if necessary, provide a replacement by the terms of the applicable warranty.

Limitations on Remedies:

Suppose a customer declines our remedy and instead seeks assistance or resolution from another company. In that case, this action will void the customer’s eligibility for any further recourse, including refunds, replacements, or chargebacks, through Rescue Rob’s Roadside.

Agreement to Accept Remedy:

By purchasing products from Rescue Rob’s Roadside, the customer agrees to:

  1. Accept the remedy we offer as the exclusive solution for product-related issues.
  2. Refrain from pursuing external assistance or services without first allowing us to address and resolve the issue.

Failure to adhere to these terms will result in the forfeiture of any claim to refunds, replacements, or chargebacks for:

  • Non-receipt of goods or services.
  • Claims that products were not as described.

Customer Acknowledgment:

By completing a purchase, the customer acknowledges and accepts these terms as binding conditions of sale. These policies ensure a fair and consistent resolution process for all parties involved.

4.    Use of Rescue Rob’s Roadside

By utilizing our services, you agree to adhere to the following terms and conditions:

  • Accuracy of Information: You must ensure that all information you provide to us is accurate and complete. We reserve the right to verify your information and to refuse service for any reason.
  • Personal Use: The service is intended for your personal use only. You may not resell it to a third party.
  • Lawful Use: You must use our service only for lawful purposes. This includes not using the service to send or store any unlawful material or fraudulent purposes.
  • Respectful Use: You must not use the service to cause nuisance, annoyance, or inconvenience.
  • No Harm: You must not attempt to harm our service or impair the proper operation of the network, platform, or application.
  • No Unauthorized Use: You must not copy, distribute, or otherwise use our service or any part without our prior written permission.
  • Identity Verification: You may be required to provide proof of identity, which you agree to provide upon request.
  • Authorized Data Use: You must use an authorized access point or data account to access our service.
  • SMS Charges: Standard messaging charges may apply when requesting services via SMS (if available in your jurisdiction).
  • Compliance with Laws: You must comply with all applicable laws and regulations while using our service. We reserve the right to terminate your access to our service if you do not abide by these terms.
  • Local Laws: You must comply with all applicable laws of your home nation, as well as the country, state, and city where you use our service. We reserve the right to terminate your use of our service if you fail to comply with any of these terms.

5.  Authorization to Receive Services:

By requesting services from Rescue Rob’s Roadside, the customer affirms that they have the legal authority to order services for the vehicle in question. This means the customer confirms that they are either the car’s owner or have received explicit permission from the owner to undertake such services on the vehicle.

Rescue Rob’s Roadside reserves the right to request proof of ownership or authorization to act on the owner’s behalf to ensure compliance with this clause.

6.    Limitation of Liability for Common Wear & Tear Damages

By utilizing the services of Rescue Rob’s Roadside, you acknowledge and agree to the following terms regarding liability and damages:

General Limitation of Liability:

Neither Rescue Rob’s Roadside, nor our affiliates shall be held liable for any indirect, incidental, special, consequential, or exemplary damages, regardless of the legal theory under which such claims may arise. This includes, but is not limited to:

  • Loss of profits, goodwill, or business reputation.
  • Loss of data or the cost of procuring substitute goods or services.
  • Any other intangible losses incurred during or as a result of using our services.

Specific Limitations:

We will not be liable for losses or damages resulting from:

  1. Service Changes or Cessation: Temporary or permanent changes or suspension of our services.
  2. Data Loss: Deletion, corruption, or failure to store content or data.
  3. Inaccurate Information: Errors or inaccuracies in your information.
  4. Account Security: Failure to maintain the confidentiality of your account details.
  5. Service Use or Misuse: Any damages arising from how you use or misuse our services.
  6. Technical Issues: Errors, defects, delays, or disruptions in service operations.
  7. Third-Party Links or Content: Issues resulting from links to external websites or third-party content provided during service.

Liability Cap:

In all circumstances, Rescue Rob’s Roadside’s total liability to you, regardless of the cause of action (contract, tort, or otherwise), will not exceed $100.

Incidental Damages:

We are not responsible for any damage caused by minor scratches, dings, or wear to the paint, weather stripping, or other parts of your vehicle that may occur during service. This is especially relevant for older vehicles where normal wear and tear are more likely.

Fundamental Terms:

These limitations form an essential basis of the agreement between you and Rescue Rob’s Roadside. They shall remain in effect indefinitely, even if any specific remedy fails in its essential purpose.

Jurisdictional Exceptions:

Certain jurisdictions may not allow limitations or exclusions of liability. Some or all of these limitations may not apply to you in such cases.

Acknowledgment of Risks:

By engaging our services, you agree to:

  • Accept the possibility of minor wear and tear as an inherent risk of receiving roadside assistance or related services.
  • Hold Rescue Rob’s Roadside, its affiliates, and service providers harmless from liability for such damages.

These terms ensure a mutual understanding and acknowledgment of reasonable risks associated with our services.

   7.      Security:

We take reasonable precautions to protect your credit card information according to industry standards.

8.  Applicable Law and Dispute Resolution

These User Terms and any disputes arising from or relating to them will be governed by and interpreted under the laws of the State of Texas without regard to conflicts of law principles.

If a dispute arises between you and Rescue Rob’s Roadside, we strongly encourage you to contact us directly to seek a resolution. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.

Any dispute that cannot be resolved amicably shall be submitted to binding arbitration under the American Arbitration Association (AAA) rules.

The arbitration shall be conducted in Texas, and the arbitrator’s decision shall be final and binding. The parties agree to keep the arbitration confidential. Each party is responsible for its attorney’s fees, and the parties shall share equally the administrative costs of arbitration.

For claims of $10,000 or less, the arbitration will be conducted based solely on written submissions unless the parties agree otherwise. For more significant claims, the right to a hearing will be determined by the AAA rules.

This arbitration agreement does not preclude either party from seeking action by federal, state, or local government agencies. Both parties also retain the right to apply to any court of competent jurisdiction for provisional relief, such as pre-arbitral attachments or preliminary injunctions.

The arbitration agreement in this section is intended to be broadly interpreted and will survive the termination of these User Terms.

Discrepancies or transaction disputes should be reported to Rescue Rob’s Roadside immediately.

10.    Service Modifications:

Rescue Rob’s Roadside reserves the right to modify or discontinue services and refuse any transaction at our discretion.

11.     Governing Law:

The laws of the State of Texas, USA, govern these terms. Disputes related to these terms will be subject to the exclusive jurisdiction of the courts located in Hays Co.

12.     Amendments:

Rescue Rob’s Roadside can amend these terms and conditions anytime. All amendments will take effect immediately upon their posting on our website.

14.    Electronic Records and IP Address Collection:

When customers pay invoices electronically at Rescue Rob’s Roadside, IP address data, and electronic signatures are collected during service. This electronic record is added to the invoice as authorization at the point of sale.

Customers agree to have their IP addresses collected and used by our Privacy Policy, which details how this information is managed and protected. Customers consent to this collection and use by completing an electronic payment, acknowledging that it forms part of the transaction record.
